Just because something has to be used for illegal activities, does not mean that the technology is illegal. A car can drive impaired and are used shooting, but they are legal.
Torrent clients I use occasionally. I've just used a few weeks ago to download a Linux distribution. In fact, the recommended method to download from the manufacturer. I also downloaded the images from the Hubble telescope in the past (these areas are public). Illegal in itself.
Just as Web browsers and FTP clients. Rapidshare and Torrent not only at home that are just good mechanisms for the exchange of content. Social content can (and is) is shared with these tools.
